Okay, it was easier to find than I thought:

3.) After meeting with my legal counsel and discovering that Joan Harris has attorney/client privilege and fiduciary duty to the Evergreen BOT (which Joan Harris confirmed via an accidental email to me), I chose not participate in this type of "investigation".

Not trying to argue the point. (I don't know enough to even make a valid argument.) Just pointing out where the whole discussion of privilege began.

I would have thought Joan/ECC had att./client privilege as well, but Joan's statement to Suzanne plus the article Badger posted seems to indicate it is not as cut and dried as that. Hopefully no lawsuits will be needed to reach a just outcome.  If her claims are proven true and ECC does offer a settlement of some kind (if they feel obligated or exposed) I'd hope Suzanne is able to insist on full disclosure of the BOT report less any redactions needed to protect victim anonymity as a part of any settlement.
